BBMK Technologies Inc. is committed to protecting the privacy of our customers’ confidential information, including the personal and health data of our customer’s patients which our customers share with us when providing our services. This Privacy Policy sets out the types of personal information and personal health information that our customers share with us, how we collect and process that information, whom we share it with as part of our services and certain rights and options that you have in this respect.

Who are we?

BBMK Technologies Inc, referred to here as “BBMK” or “we” or “our” (1000 Hwy 35 Middletown, NJ 07748 USA) owns and operates this site – https://nikohealth.com/ – and our Software as a Solution application known as “NikoHealth.” 

BBMK is not a provider of any healthcare item or service.  We develop and maintain the NikoHealth software application and license it to durable medical equipment suppliers and other commercial healthcare businesses (our “Customers”).  Our software application facilitates our Customers’ business operations.  Our Services are not intended for use by consumers.

Applicability of this Privacy Policy 

This Privacy Policy applies to our online website, NikoHealth.com (the “Website”), our software as a solution and mobile application licensed to our customers (the “Application”), and other interactions you may have with us, (collectively, the “Services”). If you disagree with the terms, do not access or use the Services, Website, Application or any other aspect of NikoHealth’s business. 

Our Collection and Use of Health Information.  A description of how we collect and use the health information that our Customers share with us appears in the Health Information Section at the end of this Policy. 

Information We Collect and Receive 

We collect and process the following personal data from you:

  • Health data from our Customers as described in the Health Information Section below;

  • Identity and Contact Data, including your name, company name, phone, and email address;

  • Business Information, including information provided in the course of the contractual or client relationship between you or your organization and BBMK, or otherwise voluntarily provided by you or your organization;

  • Metadata. When users interact with our Services, metadata is generated that provides additional context about the way you use the Site. This collects information like your Internet Protocol (IP) address, links your view and click on, and such other information and data as we may deem appropriate. This information is automatically collected and stored by our servers, similar to most websites.

  • Profile and Usage Data, including your communication preferences and information about how you use our website, including the topics you viewed or searched for, page response times, download errors, length of visits, and page interaction information (such as scrolling, clicks, and mouse-overs).   • Technical Data, including information collected during your visits to our website, the Internet Protocol (IP) address, login data, browser type and version, device type, time zone setting, browser plug-in types and versions, operating system, and platform.   • We may use analytic cookies, Profile and Usage Data, along with Technical Data (as defined above)

  • Information about other people. If you provide information to us about any person other than yourself, you must ensure that they understand how their information will be used and that they have given you their permission to disclose it to us and to allow us to use it.

How we use information

BBMK generally collects only the personal information necessary to fulfill our Services. Where additional, optional information is sought, you will be notified of this at the point of collection.

Information Collected while Using Mobile Application

While using our Mobile Application, in order to provide features of Our Mobile Application, we may collect, with your prior permission:

  • Information regarding your location

  • Device’s camera for barcodes scanning

  • Device’s storage for saving user preferences

You can enable or disable access to this information at any time, through Your Device settings.

How do we collect personal data?

The circumstances in which we can collect personal data about you include:

  • when individuals correspond directly with us by phone, email, or other electronic means, or in writing, or when you provide other information directly to us, including in conversation with our staff;

  • when you browse, complete a form, make an inquiry or otherwise interact on our website;

  • when you or your organization offer to provide, or provides, services to us;

  • when we collect data from third parties or publicly-available sources.

Automatic collection of personal information

In some instances, BBMK and its service providers use cookies, web beacons, and other technologies to automatically collect certain types of information when you visit us online, as well as through emails that we may exchange. The collection of this information allows us to customize your online experience, improve the performance, usability, and effectiveness of NikoHealth’s online presence, and measure the effectiveness of our marketing activities.

IP addresses

An IP address is a number assigned to your computer whenever you access the internet. It allows computers and servers to recognize and communicate with one another. IP addresses from which visitors appear to originate may be recorded for IT security and system diagnostic purposes. This information may also be used in aggregate form to conduct website trends and performance analysis.

Cookies

Cookies may be placed on your computer or internet-enabled device whenever you visit the site. This allows the site to remember your computer or device and serves a number of purposes.

On our site, a notification banner will appear requiring your consent to collect cookies. Contact data, Business Information, and other information voluntarily provided by you or your organization

We collect and use business contact details for individuals associated with existing and potential NikoHealth users to manage and maintain our relationship with those individuals, processing online requests, including responding to communications from individuals, performing a contract, or taking action related to a contract. Like most businesses, we use a customer relationship management system (the “CRM”) to store personal information about our business contacts.

Information you provide through the contact form on the site and the addition of that information to the NikoHealth CRM may include name, company name, employer name, title, phone, email, and other business contact details. In addition, our CRM may collect data from NikoHealth email and calendar systems concerning interactions between our staff and business contacts.

When we send you emails, we may use technologies to determine whether the email has been opened and whether the links contained within the message have been clicked on. We may combine information collected through these means with other information we maintain about you to measure interest in our specific offerings and email campaigns, improve our offerings to specific target audiences, and tailor our interactions with you.

Do we share personal data with third parties?

We never sell your data or share it with other third parties in order to obtain direct or indirect financial gains. We do not share personal information with unaffiliated third parties, except as stated in this Privacy Policy, including as necessary for our legitimate professional and business needs, to carry out your requests, to market our services, as required or permitted by law or professional standards, or otherwise with your consent.

Security of your personal data

We have put in place appropriate security measures to prevent your personal data from being accidentally lost, used, or accessed in an unauthorized way, altered or disclosed. We have also put in place procedures to deal with any suspected personal data breach and will notify you and any applicable regulator of a breach where we are legally required to do so.

What are your data protection rights?

Access – You can ask us to verify whether we are processing personal data about you and if so, to provide more specific information.

Correction – You can ask us to correct our records if you believe they contain incorrect or incomplete information about you.

Erasure – You can ask us to erase (delete) your personal data after you withdraw your consent to processing or when we no longer need it for the purpose it was originally collected.

Data portability – In some circumstances, where you have provided personal data to us, you can ask us to transmit that personal data (in a structured, commonly used, and machine-readable format) directly to another company if is technically feasible.

Right to Object – In certain circumstances, you also have the right to object to processing your personal data and to ask us to block, erase, and restrict your personal data.

Right to Withdraw Consent – You can withdraw the consent that you have previously given for one or more specified purposes to process your personal data. This will not affect the lawfulness of any processing carried out before you withdraw your consent. It may mean we are not able to provide certain products or services to you and we will advise you if this is the case.

Right to Opt-out of the Sale of Personal Information – You have the right to request to be opted-out from the sale of your personal information. However, as set forth above, we do not sell personal information.

If you would like to exercise your data protection rights, you can email inquiries@nikohealth.com. We may need to request specific information from you to help us confirm your identity and ensure your right to access the information or to exercise any of your other rights. This helps us ensure that personal data is not disclosed to any person who has no right to receive it. Depending on the circumstances, we may be unable to comply with your request based on other lawful grounds.

How long do we retain personal data?

We retain personal data to provide our Services, stay in contact with you, and comply with applicable laws, regulations, and professional obligations that we are subject to. Unless a different time frame applies due to business needs or specific legal, regulatory, or contractual requirements, where we retain personal data in accordance with these purposes, we retain such personal data for seven years.

Do we link to other websites?

Our website may contain links to other sites. Please review the destination websites’ privacy notices before submitting personal data on those sites. Whilst we try to link only to sites that share our high standards and respect for privacy, we are not responsible for the content, security, or privacy practices employed by other sites.

Changes to this privacy policy

We may update this privacy policy at any time. When we do, we will revise the “updated” date appearing on this Policy. We encourage you to frequently check this page for any changes to stay informed about how we collect and use your information. You acknowledge and agree that it is your responsibility to review this privacy policy periodically and become aware of modifications. Your continued use of the Services after changes have been posted indicates your consent to the amended terms of the Privacy Policy. 

Who can you contact for privacy questions or concerns?

You may at any time request that we permanently remove all personal information stored by it at any time by delivering notice requesting such removal to inquries@nikohealth.com. Upon such request, we will remove all such information and will not thereafter use personally identifiable information about you except as may be required or permitted by sections (a) and (c) above. Such a request will automatically terminate your right to access or use the Site and request and receive any products or Services.

Health Information Section

How our Service utilizes health information

Our Customers collect the personal health information of their patients and share this information with us for processing as part of the Services.  The personal health information disclosed to us by our Customers constitutes “Protected Health Information” or “PHI” under the Health Insurance Portability and Accountability Act, commonly referred to as “HIPAA.”  Protected Health Information is information that is created or maintained by certain entities, such as health care providers and our Customers generally, that relates to (a) an individual’s past, present or future physical or mental health or condition, (b) the provision of health care to an individual, or (c) the past, present, or future payment for the provision of healthcare to an individual and that identifies the individual, or reasonably could be used to identify the individual.

Our Role as a Business Associate Under HIPAA.  To the extent our Customer is a “Covered Entity” under HIPAA, we are a “Business Associate” of our Customer when processing the Customer’s PHI.  As a Business Associate under HIPAA, our handling of Customer PHI is governed by HIPAA’s health data privacy and security regulations. 

We have entered into a Business Associate Agreement with each of our Customers who are Covered Entities under HIPAA.  We agree in our Business Associate Agreements to comply with all of the health data security and privacy regulations applicable to Business Associates under HIPAA.  In addition, we take steps to comply with all state data privacy and security laws applicable to us when we do business in such states.  

How we collect Health Information 

We collect health information through our application from our Customers. We collect the minimum amount of information necessary to perform or improve the Services.

How we use Health Information

We use the health information provided to us by our Customers to perform our Services to our Customer. 

We may link usage data to the health information we collect from our Customers. If we link this usage data to health information, we will treat such linked information as under the protections required of Business Associates under HIPAA and our Business Associate Agreements with our Customers. 

We may also de-identify, anonymize or aggregate the health information we receive from our Customers as permitted by law and our agreements with our Customers (“Aggregate Information”). To the extent that such information is de-identified according to HIPAA standards, the Aggregate Information is not PHI because it cannot be used to identify an individual.  Such de-identified information may be used by us for any lawful purpose.

How we share Health Information

We do not sell, trade or rent health information to others. We may share health information to the extent permitted by HIPAA and our Business Associate Agreements with our Customers.  Such disclosures of an individual’s health information may include disclosures:

  • By us in our capacity as a Business Associate of our Customer and referenced in the Notice of Privacy Practices of our Customers.

  • By us internally among our current or future business units, brands and our affiliates to provide, maintain or improve our Services.

  • By us with our contractors and vendors (including third-party hosting providers) who need access to such information in order for us to carry out work or perform our Services for or on behalf of our Customers.

  • By us to transaction parties in the event we go through a business transition, such as a merger, acquisition, divestiture, restructuring, reorganization, dissolution, bankruptcy or sale of all or a portion of our assets.

  • By use for legal purposes as provided by HIPAA and our Business Associate Agreement, such as when we think it is necessary to investigate or prevent actual or expected fraud, criminal activity, injury or damage to us or others or when otherwise required by law, regulation, subpoena or court order, or if necessary to protect the rights, property or safety of our business or others. We may share health information if necessary to enforce this Privacy Policy or Terms of Use of the Site. We reserve the right to report to appropriate law enforcement or government agencies activities that we, in good faith, believe to be harmful or unlawful, with or without providing notice to the individual whose health information is reported.
